WorkPath Terms of Use

These Terms of Use govern your access to and use of WorkPath, including the WorkPath website, assessment application, assessment scenarios, reports, profiles, and related services.

WorkPath is operated by True North Digital LLC, an Alabama limited liability company doing business as WorkPath. In these Terms, "WorkPath," "we," "us," and "our" refer to True North Digital LLC.

By accessing or using WorkPath, you agree to these Terms. If you use WorkPath on behalf of an organization, you represent that you have authority to do so.

1. What WorkPath Provides

WorkPath provides scenario-based AI readiness assessments, personal profiles, reports, and related services designed to help individuals and organizations understand practical AI readiness in particular work, learning, and organizational contexts.

A WorkPath assessment may include role-specific scenarios, written responses, AI-assisted analysis, scoring, narrative feedback, and individual or aggregate reporting.

2. Developmental and Advisory Use

WorkPath is intended for developmental, educational, workforce-readiness, training, research, and organizational-planning purposes.

WorkPath is not a certification, credential, license, psychometric diagnosis, employment test, legal-compliance tool, or guarantee of job or academic performance.

A WorkPath result is evidence from a particular assessment experience. It should be interpreted as one source of information among others. WorkPath results should not be used as the sole basis for hiring, termination, promotion, compensation, admission, academic grading, discipline, credentialing, licensing, eligibility for benefits or services, legal or regulatory compliance, or other consequential or high-stakes decisions.

Organizations using WorkPath are responsible for deciding how assessment information is used and for ensuring that their use complies with applicable law, institutional policies, labor agreements, contractual requirements, and appropriate professional standards.

3. AI-Assisted Assessment

WorkPath uses AI systems and automated tools to analyze written responses and help generate scores, observations, feedback, and reports.

AI-generated and AI-assisted outputs may be incomplete, inaccurate, inconsistent, or otherwise imperfect. WorkPath does not guarantee that an assessment output is error-free or appropriate for every purpose.

Participants and sponsoring organizations should interpret WorkPath results with appropriate human judgment.

4. Individual and Sponsored Assessments

You may use WorkPath independently or through an assessment sponsored by an organization, school, employer, program, or other customer.

For a sponsored assessment, WorkPath may provide information to the sponsoring organization according to the particular engagement, as described in the WorkPath Privacy Policy.

WorkPath will seek to provide practical notice in or before a sponsored assessment describing the sponsor and the types of individual information the sponsor is expected to receive.

5. Your Content and Responsibilities

You retain whatever ownership or other rights you have in the original content you submit to WorkPath, including your written assessment responses.

You give WorkPath permission to host, store, process, analyze, reproduce, and otherwise use that content as reasonably necessary to:

  • provide the assessment and your report;
  • support the assessment experience;
  • provide agreed reporting to a sponsoring organization;
  • operate, secure, evaluate, and improve WorkPath;
  • comply with legal and contractual obligations;

all subject to the WorkPath Privacy Policy and any applicable customer agreement.

You are responsible for the information you submit. You agree to provide information that is accurate to the best of your knowledge and appropriate for the assessment context.

Assessment scenarios generally do not require you to disclose real confidential or sensitive information. You should not submit confidential, proprietary, personally sensitive, or third-party information unless you have the right to provide it and doing so is appropriate.

You are responsible for safeguarding access links, codes, tokens, passwords, and report files provided to you.

6. Acceptable Use

You may not use WorkPath to:

  • violate applicable law or another person's rights;
  • submit unlawful, harmful, deceptive, abusive, discriminatory, or malicious content;
  • interfere with the operation, security, integrity, or availability of WorkPath;
  • attempt to obtain unauthorized access to WorkPath systems, accounts, data, or infrastructure;
  • systematically scrape, harvest, copy, or extract WorkPath scenarios, prompts, scoring logic, reports, or data;
  • reverse engineer, decompile, disassemble, or attempt to derive WorkPath's underlying prompts, scoring methods, system design, or workflows;
  • use WorkPath materials to build, train, benchmark, or improve a competing assessment, profile, scoring system, or AI-readiness product;
  • resell, sublicense, or commercially exploit WorkPath except as expressly authorized in writing.

7. WorkPath Intellectual Property

True North Digital LLC owns or licenses WorkPath and its associated intellectual property, including its assessment framework, scenario designs, scoring approach, software, text, report designs, trademarks, trade names, and related materials.

Your ownership of the content you submit does not give you ownership of WorkPath's assessment materials, scoring methods, software, or other intellectual property.

Except as permitted by these Terms, you may not reproduce, modify, distribute, publish, sell, license, or commercially exploit WorkPath materials without written permission.

Subject to these Terms, WorkPath gives you a limited, non-exclusive, non-transferable right to access and use the service for its intended purpose.

8. Your Profile and Report

Your WorkPath profile is intended to be useful to you.

Subject to any applicable sponsor or customer agreement, you may download, save, print, copy, and share your own WorkPath profile or report for personal, educational, professional-development, or workforce-readiness purposes.

Sharing your report does not turn it into a certification, credential, license, or endorsement by WorkPath or by any sponsoring organization.

WorkPath may use assessment information to operate, maintain, evaluate, secure, and improve the service in accordance with the WorkPath Privacy Policy.

WorkPath may use aggregate or de-identified information for research, benchmarking, product improvement, reporting, and development when that information does not reasonably identify an individual.

9. Organizational Names and Attribution

WorkPath may identify customers, sponsors, pilot organizations, research collaborators, or other organizations only where permitted.

A reference to an organization does not, by itself, mean that the organization endorses, certifies, validates, sponsors, or recommends WorkPath.

You may not use the WorkPath name, logo, reports, badges, or other branding in a way that falsely implies certification, credentialing, endorsement, institutional approval, or another relationship that does not exist.

10. Privacy

Your use of WorkPath is also governed by the WorkPath Privacy Policy.

The Privacy Policy explains what information WorkPath collects, how the assessment uses AI, how information may be shared in sponsored assessments, and how WorkPath handles and protects information.

11. No Professional Advice

WorkPath does not provide legal, employment, educational, psychological, medical, compliance, or other professional advice.

Decisions involving employment, admission, academic grading, discipline, credentialing, legal compliance, workplace policy, or similar matters should be made by appropriately qualified people using information and processes beyond WorkPath alone.

12. Disclaimers

WorkPath is provided on an "as is" and "as available" basis.

To the fullest extent permitted by law, WorkPath disclaims warranties, express or implied, including warranties of accuracy, reliability, availability, merchantability, fitness for a particular purpose, and non-infringement.

WorkPath does not warrant that the service will always be uninterrupted, secure, or error-free, or that an assessment result will meet every user's or organization's expectations or requirements.

Nothing in these Terms excludes rights or protections that cannot legally be excluded.

13. Limitation of Liability

To the fullest extent permitted by law, True North Digital LLC and its members, managers, employees, contractors, service providers, and representatives will not be liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption arising from or related to use of WorkPath.

To the fullest extent permitted by law, WorkPath's total liability for a claim arising from these Terms or use of the service will not exceed the amount paid to WorkPath for the service giving rise to the claim or one hundred dollars ($100), whichever is greater.

Nothing in these Terms limits liability that cannot legally be limited.

14. Responsibility for Misuse

You are responsible for your own intentional or unlawful misuse of WorkPath and for violations of third-party rights caused by content or materials you submit.

If your misuse of WorkPath, violation of these Terms, or infringement of third-party rights results in a claim against True North Digital LLC, you agree to indemnify WorkPath and cover the resulting costs, including reasonable attorneys' fees.

If you use WorkPath on behalf of an organization, that organization may have additional responsibilities under a separate customer, pilot, research, or services agreement.

15. Changes to WorkPath

WorkPath may modify, update, suspend, discontinue, or limit parts of the service as the product evolves.

Assessment content, scoring methods, report formats, features, access methods, and pricing may change over time.

WorkPath may also correct errors, improve assessment methods, or change how features operate without preserving earlier versions.

16. Changes to These Terms

WorkPath may update these Terms from time to time.

When the Terms change, WorkPath will post the revised version with a new "Last updated" date.

Your continued use of WorkPath after revised Terms are posted means the revised Terms apply to your subsequent use of the service.

17. Governing Law

These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.

Unless applicable law or a separate written agreement requires otherwise, disputes arising from these Terms or use of WorkPath will be handled in state or federal courts located in Alabama.
