WorkPath Terms of Use

These Terms of Use govern your access to and use of WorkPath, including the WorkPath website, assessment application, assessment scenarios, reports, profiles, related materials, and associated services. WorkPath is operated by True North Digital LLC, an Alabama limited liability company, doing business as WorkPath. In these Terms, "WorkPath," "we," "us," and "our" refer to True North Digital LLC.
By accessing or using WorkPath, you agree to these Terms. If you use WorkPath on behalf of an organization, you represent that you have authority to accept these Terms for that organization.
1. What WorkPath Provides
WorkPath provides scenario-based AI readiness assessments, profiles, reports, and related services designed to help individuals and organizations understand practical AI readiness in specific work, learning, or organizational contexts.
WorkPath assessments may include role-specific scenarios, written responses, automated analysis, scoring, narrative feedback, and individual or aggregate reporting.
2. Developmental and Advisory Use
WorkPath is intended for developmental, educational, workforce readiness, training, and organizational planning purposes.
WorkPath is not a certification, credential, license, psychometric diagnosis, employment test, legal compliance tool, or guarantee of job performance. WorkPath results should be interpreted as one input among others and should not be used as the sole basis for hiring, promotion, admission, termination, compensation, discipline, credentialing, or other high-stakes decisions.
Organizations using WorkPath are responsible for determining how assessment results are used and for ensuring that their use complies with applicable laws, policies, labor agreements, institutional requirements, and ethical standards.
3. Individual and Sponsored Assessments
You may access WorkPath as an individual user or through an organization-sponsored assessment.
If you take a WorkPath assessment through an organization-sponsored link, access code, pilot, customer engagement, or similar arrangement, your responses, results, report, profile, or summary information may be shared with the sponsoring organization according to the terms of that engagement and the WorkPath Privacy Policy.
Organizations may receive individual reports, aggregate summaries, readiness patterns, cohort-level observations, or other outputs depending on the engagement.
4. User Responsibilities
You are responsible for the information you submit to WorkPath. You agree to provide information that is accurate to the best of your knowledge and appropriate for the assessment context.
You agree not to submit confidential, proprietary, personal, or third-party information unless you have the right to provide it and it is appropriate for the assessment context.
You are responsible for maintaining the confidentiality of any access links, tokens, or credentials provided to you.
5. Acceptable Use
You agree not to use WorkPath to:
- violate any law, regulation, policy, or third-party right;
- submit unlawful, harmful, deceptive, abusive, discriminatory, or malicious content;
- interfere with or disrupt the operation, security, integrity, or availability of WorkPath;
- attempt to gain unauthorized access to WorkPath systems, accounts, data, or infrastructure;
- scrape, copy, harvest, extract, or systematically collect WorkPath content, scenarios, prompts, scoring logic, reports, or data;
- reverse engineer, decompile, disassemble, or otherwise attempt to derive the underlying design, prompts, scoring methods, workflows, or system behavior of WorkPath;
- use WorkPath materials to build, train, benchmark, or improve a competing assessment, profile, scoring system, or AI readiness product;
- resell, sublicense, or commercially exploit WorkPath except as expressly authorized in writing.
6. Intellectual Property
True North Digital LLC owns or licenses WorkPath, including its assessment framework, scenario designs, scoring approach, reports, text, design, software, trademarks, trade names, and related materials.
Except as expressly permitted, you may not copy, reproduce, modify, distribute, display, publish, sell, license, create derivative works from, or otherwise exploit any WorkPath materials without prior written permission.
Subject to these Terms, WorkPath grants you a limited, non-exclusive, non-transferable permission to access and use WorkPath for its intended purpose.
7. Your Results and Reports
Subject to these Terms and any applicable customer or sponsor agreement, you may use your own WorkPath report or profile for personal, educational, professional development, or workforce readiness purposes.
WorkPath may use assessment responses, results, reports, metadata, and usage information to operate, maintain, evaluate, secure, and improve WorkPath, consistent with the WorkPath Privacy Policy and any applicable customer agreement.
WorkPath may use de-identified or aggregated information for research, product improvement, benchmarking, reporting, or development purposes, provided such use does not reasonably identify an individual user unless otherwise permitted.
8. Organizational Names and Attribution
WorkPath may reference organizations, customers, sponsors, pilots, or collaborators only where permitted.
Unless expressly stated, any reference to an organization does not imply endorsement, sponsorship, certification, approval, institutional validation, partnership, or recommendation by that organization.
You may not use the WorkPath name, logo, reports, badges, or other branding in a way that implies endorsement, certification, credentialing, or institutional approval unless expressly authorized in writing.
9. Privacy
Your use of WorkPath is also governed by the WorkPath Privacy Policy, which explains how WorkPath collects, uses, shares, and protects information.
By using WorkPath, you acknowledge that the WorkPath Privacy Policy is available.
10. Third-Party and AI Systems
WorkPath may use third-party technology providers, hosting services, analytics services, AI systems, or other vendors to operate and improve the service.
WorkPath does not guarantee that AI-generated or AI-assisted outputs will be complete, accurate, error-free, unbiased, or suitable for every purpose. Users and organizations are responsible for reviewing and interpreting WorkPath outputs appropriately.
11. No Professional Advice
WorkPath does not provide legal, employment, educational, psychological, compliance, or professional advice.
Any decisions involving hiring, promotion, admission, discipline, training, credentialing, legal compliance, workplace policy, or similar matters should be made by qualified people using appropriate processes and information beyond WorkPath alone.
12. Disclaimers
WorkPath is provided on an "as is" and "as available" basis. To the fullest extent permitted by law, WorkPath disclaims all warranties, express or implied, including warranties of accuracy, reliability, availability, fitness for a particular purpose, non-infringement, and merchantability.
WorkPath does not warrant that the service will be uninterrupted, secure, error-free, or that results will meet your expectations or requirements.
13. Limitation of Liability
To the fullest extent permitted by law, True North Digital LLC, its members, managers, employees, contractors, service providers, and representatives will not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption arising out of or related to your use of WorkPath.
To the fullest extent permitted by law, WorkPath's total liability for any claim arising out of or related to these Terms or your use of WorkPath will not exceed the amount paid by you to WorkPath for the service giving rise to the claim, or one hundred dollars ($100), whichever is greater.
14. Indemnification
You agree to indemnify and hold harmless True North Digital LLC, its members, managers, employees, contractors, service providers, and representatives from and against any claims, damages, liabilities, losses, costs, and expenses, including reasonable attorneys' fees, arising from your misuse of WorkPath, violation of these Terms, violation of law, or infringement of third-party rights.
15. Changes to WorkPath
WorkPath may modify, suspend, discontinue, or limit access to any part of the service at any time, with or without notice.
WorkPath may update assessment content, scoring methods, report formats, features, pricing, access methods, or related materials as the service evolves.
16. Changes to These Terms
WorkPath may update these Terms from time to time. When changes are made, the updated Terms will be posted with a revised "Last updated" date.
Your continued use of WorkPath after changes are posted means you accept the updated Terms.
17. Governing Law
These Terms are governed by the laws of the State of Alabama, without regard to conflict-of-law principles.
Any disputes arising out of or related to these Terms or WorkPath will be handled in the state or federal courts located in Alabama, unless otherwise required by applicable law or a written agreement between WorkPath and an organization.
